ARTICLE 1 - Object of the program

The purpose of the Loly's Family loyalty programme is, under the conditions set out in these general conditions, to accumulate points and to offer its members a certain number of preferential and exclusive advantages.

ARTICLE 2 - Scope of validity 

The Loly's Family program is only valid on the website www.secretsdeloly.com. The advantages linked to the loyalty programme cannot be combined with any other discounts, promotions or commercial operations in progress, unless otherwise stated. 

ARTICLE 3 - Membership conditions

Membership of the Loly's Family loyalty programme can only be done via the website www.secretsdeloly.com by creating an account on the page www.secretsdeloly.com/account.

The Loly's Family loyalty programme is accessible subject to acceptance of these general conditions, and membership is free and open to any individual over 18 years of age, acting in a personal capacity, residing in France and Belgium.

To join the loyalty programme, it is compulsory to fill in your surname, first name, e-mail address and hair texture. Membership will only be registered if the mandatory information requested is complete and usable. Any change in the personal data communicated for the purposes of membership in the Loly's Family loyalty program must be notified as soon as possible by email to contact@secretsdeloly.com.

ARTICLE 4 - Points and rewards

4.1 Global functioning of the program

The loyalty program allows each member, once his customer account is created, to earn points that will be directly added to his customer account. Each member will be able, as soon as his balance allows it, to have advantages, discounts or gifts on the website www.secretsdeloly.com. 

4.2 Accumulation of points

The accumulation of points assumes the prior identification of the member by logging into his loyalty account and is carried out at each purchase. The points scale is 1€ excluding taxes = 1 point. Other actions are possible in order to accumulate points on your customer account:

• create a customer account: 50 points

• subscribe to the Instagram page @lessecretsdeloly via the link on the page https://www.secretsdeloly.com/pages/rewards : 10 points

• follow the Facebook page @lessecretsdeloly via the link of the page https://www.secretsdeloly.com/pages/rewards : 10 points

• subscribe to the Tiktok page @lessecretsdeloly via the link of the page https://www.secretsdeloly.com/pages/rewards : 10 points

• subscribe to the YouTube page @lessecretsdeloly via the link of the page https://www.secretsdeloly.com/pages/rewards : 10 points

• Leave a review only via the email sent for this purpose: 20 points 

• Add a photo in the form in the email: 10 points additional

• Add a video when filling in the form in the email: 20 points additional

Each member can check his or her points balance at any time by logging into his or her customer account on the www.secretsdeloly.com website.

4.3 Period of validity of points

Points are valid for 12 months from the last transaction made on the customer's loyalty account or the last action carried out. If no purchase or action is recorded on the loyalty account for 12 months from the last purchase made, the points balance will automatically be reset to zero. If a member has made a purchase without logging into their customer account, they may contact customer service at contact@secretsdeloly.com to claim their points entitlement on presentation of the purchase confirmation email.

4.4 Rewards and discounts 

Members of the loyalty programme collect points for their purchases and actions. Each member can decide to save points to achieve higher discounts: :

• from 150 available points = 15€ discount for a minimum purchase of 15€
• from 200 available points = 20€ discount for a minimum purchase of 15€
• from 250 available points = 25€ discount for a minimum purchase of 15€
• from 400 available points = 40€ discount for a minimum purchase of 15€
• from 1 000 available points = 100€ discount for a minimum purchase of 15€

These discounts are valid for 6 months from the date of release and the minimum amount to claim each discount must be the amount of the order excluding delivery.

4.5 Cancellation of points 

Points relating to a purchase that has been refunded or returned will be cancelled and deducted from the member's loyalty account.

ARTICLE 5 - Levels and benefits 

The accumulation of points is done automatically on the account of each member. Three levels specific to the Loly's Family loyalty program can be by all members according to the evolution of their points balance:

Sweet Loly : each member who joins the loyalty programme reaches this first level. Each member can then have :

• 1€ tax free = 1 point 

• 10% on his/her birthday

Super Loly : each member who has spent between €150 and €300 from an order and over a period of 12 months reaches this level. Everyone can then have:

• 1€ tax free = 1,25 points 

• 15% on his/her birthday

• 50 free points 

• Special operations with double points

Wonder Loly : each member who has spent at least €300 from an order and over a period of 12 months reaches this level. Everyone can then have: 

• 1€ tax free= 1,5 points 

• 20% on his/her birthday

• 100 free points 

• Special operations with double points

ARTICLE 6 - Referral

Members of the Loly's Family loyalty programme have the opportunity to refer their friends and family. The member and referee offers a €5 discount to his/her referred friend for his/her first order of a minimum of €50. Once the transaction is completed, the referred person receives 50 points on his/her customer account.

ARTICLE 7 - Protection of personal data

The protection of the personal data of the users of the website of LES SECRETS DE LOLY is governed by the relevant Privacy Policy, https://www.secretsdeloly.com/en/policies/privacy-policy.
By exception, the present article indicates the specificities applicable to each user (hereafter called "Member") subscribing to the Loly's Family loyalty program.

7.1 Means of collection

The personal data of the Member is collected directly from him, at the time of his adhesion to the Loly's Family loyalty program on the website https://www.secretsdeloly.com.
The Member is solely responsible for the quality of the personal data that he/she transmits to LES SECRETS DE LOLY.

7.2 Data collected

The following personal data are collected on a mandatory basis as part of the membership of the Loly's Family programme: title, surname, first name, email address, postal address. This data is necessary for Les Secrets de Loly to ensure the authentication of the Member. The absence of such data, their irrelevance or their non-updating is likely to cause a delay in the processing of the Member's request, or even its refusal.

The other personal data collected by Les Secrets de Loly in the context of a membership are optional, in order to get to know the Member better and send him/her communications adapted to his/her profile.
For example, Les Secrets de Loly processes the history of the Member's purchases and use of the website (for example by collecting navigation data via cookies, subject to consent). This processing is not in itself necessary for the creation of a Member's account, but becomes necessary when it comes to managing the Member's eligibility for the various benefits of the Loly's Family program.

7.3 Purposes and legal basis

As a Member, your personal data may be processed for the following purposes and on the following legal bases:
 

• Management and animation of the loyalty programme and communities: informing the Member about the loyalty programme or available services, managing the Member relationship, card benefits and card operations.
• This processing is necessary for the execution of the Loly's Family Terms of Use.

• Commercial canvassing by electronic means: establishment of customer profiles, canvassing by e-mail and/or SMS, data collection via cookies.
• This processing is based on the Member's consent. By exception, commercial prospecting by post may be based on the legitimate interest of Les Secrets de Loly.  

• Conducting customer satisfaction surveys and studies: polls, product tests, sales statistics and organisation of competitions.
• This processing is based on the legitimate interest of Les Secrets de Loly to continuously improve its service and products.

• Exercise by the Member of his/her individual rights: management of requests to exercise the Member's rights concerning the use of his/her personal data.
• This processing is based on a legal obligation.

• Management of pre-litigation and litigation.
• This processing is based on the legitimate interest of Les Secrets de Loly to establish proof of a right or contract.

7.4 Retention periods 

Les Secrets de Loly keeps the personal data of the Member until the achievement of the purposes for which they were collected, that is to say, for the duration of membership in the Loly's Family program plus the applicable legal prescription periods, in order to keep proof of the transactions.
In some cases, a longer retention period is imposed on Les Secrets de Loly by a legal obligation.
Please note that the data collected for commercial prospecting purposes can only be kept until the withdrawal of your consent, and up to 3 (three) years from the last commercial contact with Les Secrets de Loly (e.g. when the Member clicks on an offer sent to him).

7.5 Recipients

Les Secrets de Loly only transmits the Member's personal data to those recipients who have the strict need to ensure the processing in accordance with the purpose of their collection, including the service providers involved in the management of the Loly's Family program.

7.6 Data transfers outside the European Union

Some of the personal data we collect may be transferred outside the European Union, mainly to Canada and the United States, where Les Secrets de Loly service providers are present.

In case of transfer, Les Secrets de Loly ensures that it is (i) carried out to a country subject to an adequacy decision of the European Commission under Article 45 of the RGPD, or (ii) framed by appropriate safeguards under Article 46 of the RGPD, including the standard contractual clauses of the European Commission, as well as by technical and organizational measures to ensure a high level of security and confidentiality of data, similar to that required by the RGPD.

7.7 Individual rights of the Member

The Member has individual rights regarding his or her personal data: right of access, right to rectification, right to erasure, right to limitation, right to opposition, right to portability.
The Member may exercise these rights by sending a request to:

Furthermore, the Member may at any time rectify his/her own personal data that he/she has entered by going to his/her "My account" page on the Les Secrets de Loly website.
The request must indicate the right(s) that the Member wishes to exercise. In accordance with Article 12.6 of the RGPD, when Les Secrets de Loly has reasonable doubts as to the identity of the person exercising his/her rights, a piece of identification may be requested.
Finally, the Member has the right to lodge a complaint with the supervisory authority, the Commission Nationale de l'Informatique et des Libertés (CNIL), in the event that he/she considers that he/she is unable to exercise his/her rights or wishes to report a breach of the rules for the protection of personal data.
